  • E-Notarized POA shall be issued in Arabic only by email from the Court. Should you require it in English and in Arabic format, a bilingual e-notarization fee of AED 199 shall apply.
 

Description and Powers

Description

A property power of attorney is used in situations where the owner of the real estate property in the UAE needs to appoint someone to manage, lease or sell his/her property. The owner can appoint anyone in the UAE to carry out such tasks. The specific details of the property (or properties, where more than one) are required to be included in the power of attorney.

Powers included

A property power of attorney in the UAE typically includes powers to:

  • manage and lease real estate property; and/or
  • sell the real estate property to any third party.

POA for Property in Dubai

A power of attorney for sale of property in Dubai can be signed by the owner before a Notary Public if the title deed has already been issued by the Dubai Land Department in the name of the owner.

If the property in question is mortgaged (either through Islamic or conventional finance), the Notary Public will require an NOC to be obtained from the financing bank along with a true copy of the title deed issued by the bank.

If the title deed has not been issued for the property, it would not be possible for the owner to sign the power of attorney before a Notary Public in Dubai. In this case, the owner will either have to wait for the title deed to be issued by the Dubai Land Department or sign the power of attorney in his home country and follow the process of legalisation.

In addition, if the attorney/agent appointed in the power of attorney for property in Dubai does not have a UAE residence visa, the power of attorney may not be accepted for the purposes of registering the Ejari.

 

POA for Sale of Property in Abu Dhabi and other Emirates

For Abu Dhabi and all other Emirates, the Notary Public may require for the original sale and purchase agreement or the original title deed of the property to be seen to allow the owner to sign the power of attorney.

If the property is mortgaged, the Notary Public may also require for an NOC to be obtained from the financing bank along with a true copy of the title deed or the sale and purchase agreement issued by the bank.

 

Signing Process

Once we have prepared the draft of your property power of attorney, based on your location, the following process for the signing will need to be followed:

Scenario 1: Sign in UAE for use in UAE

If you reside in the UAE, a property power of attorney can be signed before a Notary Public in Dubai, Abu Dhabi, Sharjah, Ras Al Khaimah, Fujairah, Ajman or Um Al Quwain. Regardless of the place of signing within the UAE, a property power of attorney remains valid throughout the UAE.

Scenario 2: Sign outside UAE for use in UAE

If you reside outside the UAE, a property power of attorney can be signed before a Notary Public in the country of your residence. Once signed, attestations by the following government departments will be required before it can be used in the UAE:

1. Country of your residence

  • Ministry of Foreign Affairs in the country of your residence
  • UAE Embassy in the country of your residence

2. United Arab Emirates

  • Ministry of Foreign Affairs in the UAE
  • Ministry of Justice in the UAE after Arabic translation

Our fee for assistance on the UAE attestations is AED 899. This includes the government fee. However, if the document is treated as commercial document by the UAE Ministry of Foreign Affairs, the government fee of AED 2,000 shall apply in addition.

Scenario 3: Sign in UAE for use outside UAE

If you reside in the UAE, a property power of attorney can be signed before a Notary Public in Dubai, Abu Dhabi, Sharjah, Ras Al Khaimah, Fujairah, Ajman or Um Al Quwain. Depending upon the country where the power of attorney will be used, attestations by the following government departments will be required:

  • Ministry of Foreign Affairs in the UAE
  • Embassy/consulate of the country where the power of attorney will be used

Scenario 4: Property Power of Attorney for India

If the power of attorney is intended to be signed in the UAE and used in India, the draft can be prepared by us and you will need to sign the draft at the IVS Global offices.
