A marriage power of attorney is an important legal document for conducting a marriage in the UAE. By use of this document, another person can be authorised to act on behalf of the father or legal guardian of a female to provide consent for the marriage of the female before a court in the UAE. In the event the father or the legal guardian of a female resides outside of UAE or is unable to attend the marriage ceremonies, then a marriage power of attorney must be mandatorily prepared for execution of the marriage.

Benefits of a Marriage POA

These are the benefits of a marriage power of attorney in the United Arab Emirates:

  • A marriage power of attorney can be used to effectuate a female’s marriage in the absence of the father or a legal guardian in the UAE.
  • A marriage power of attorney gives liberty to the female’s father / legal guardian to choose another person who will be taking the decisions during the marriage process on their behalf. The only requirement is that the chosen attorney should be a male and above 21 years of age.
  • When you create a marriage power of attorney, you decide when it goes into effect and what the agent can and can’t do. Different powers relating to a marriage can be assigned by way of a marriage POA.
  • A marriage POA puts the weight off the shoulders of a father / legal guardian.
  • A properly executed marriage power of attorney is accepted by the government and judicial departments of all Emirates in the UAE.
  • The father / legal guardian of a female can subsequently revoke the powers given under a marriage power of attorney.
  • A marriage POA allows you to appoint more than one agent to execute your tasks.
 

Signing Process for a Marriage Power of Attorney

The procedure for signing and legalisation depends on whether a marriage POA is signed inside or outside of the United Arab Emirates.

Option 1: Marriage POA signed in UAE for use in UAE

In all the Emirates of United Arab Emirates, a marriage power of attorney can be signed, stamped and notarized before a notary public. A marriage POA notarized by the notary public of any Emirate is recognized and accepted all over the UAE.

Online Notarization in the Emirate of Dubai

The Dubai notary public provides a service where a marriage POA can be notarized online through the BOTIM mobile application. The process for online notarization is as follows:

  • An e-mail is sent to the designated e-mail address of the Dubai notary wherein the copy of the final marriage POA and the identification cards of the principal and the agent are attached. The mobile number of the principal linked to the BOTIM mobile application should be mentioned in the email.
  • A face-to-face video call is organised by the Dubai notary public at a designated time. The video call is organised for the purposes of verifying the identities of the parties (principal and agent) to the marriage POA and for approving the POA.
  • The approved and stamped marriage POA will be released by the Dubai notary public. You can collect the marriage POA from the notary public office in Dubai.

Online Notarization in the Emirate of Abu Dhabi

Legal matters in Abu Dhabi are handled by the Abu Dhabi Judicial Department (ADJD), which also offers notary public services for online notarization of marriage power of attorneys. These steps can be taken to have the marriage POA notarised online in Abu Dhabi.  

  • The bilingual (English and Arabic) copy of the marriage power of attorney is uploaded on the portal of Abu Dhabi Judicial Department along with the identification cards of the principal, agent and legal translator.
  • After approving the marriage POA, ADJD will send the online link for the payment of the government fees.
  • ADJD upon approving the POA will send the payment link for payment of the government fees.
  • ADJD will send you a digitally signed copy of the marriage POA. This digitally signed copy of the marriage POA is deemed as an original marriage power of attorney.

Option 2: Marriage POA signed outside UAE for use in UAE

You can also choose to sign the marriage POA in front of a notary public in your own country. To ensure that the marriage POA is accepted in UAE, it is essential that the marriage POA is legalised by these departments:
